1. Agreement to Terms

By accessing or using Bivernado ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Bivernado is a brand intelligence platform that provides structured data about brand visual identities, including colors, typography, logos, and other design elements. The Service includes a web application, API access (where applicable), and data export functionality.

3. User Accounts

  • You must provide accurate information when creating an account
  • You are responsible for maintaining the security of your account
  • You must not share your account credentials with others
  • You must be at least 16 years old to use the Service

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to reverse-engineer or scrape the platform beyond normal API usage
  • Redistribute bulk data exports commercially without a license
  • Interfere with or disrupt the Service or its infrastructure
  • Impersonate any person or entity

5. Data and Content

Brand data provided through the Service is compiled from publicly available sources and AI analysis. While we strive for accuracy, we do not guarantee that all data is complete, accurate, or up-to-date. The Service is provided for informational and research purposes.

6. Intellectual Property

The Bivernado platform, including its design, code, analytical methodologies, and compiled datasets, is our intellectual property.

Third-Party Trademarks: All product names, logos, brands, and other trademarks or images featured or referred to on Bivernado are the property of their respective trademark holders. These trademark holders are not affiliated with, nor do they endorse or sponsor Bivernado, our products, or our website. The use of any trademark on Bivernado is for identification and reference purposes only and does not imply any association with the trademark holder.

Fair Use: Bivernado displays brand identity data — including colors, typography, logos, and other visual elements — for purposes of analysis, commentary, criticism, and research. Such use constitutes fair use under applicable copyright and trademark law (including EU Directive 2019/790 and Czech Act No. 121/2000 Coll.). Bivernado does not claim ownership of any third-party intellectual property displayed on this platform.

Content Removal: If you are a brand owner and wish to have your data removed from Bivernado, please visit our Content Removal page or contact us at legal@bivernado.com.

7. Subscription and Payments

  • Free tier access is available at no cost with certain limitations
  • Paid subscriptions are billed monthly or annually as specified
  • You may cancel your subscription at any time
  • Refunds are handled on a case-by-case basis

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

9. Termination

We may terminate or suspend your access to the Service at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

10. Governing Law

These terms are governed by the laws of the Czech Republic. Any disputes shall be resolved in the courts of Pilsen, Czech Republic.

11. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify users of material changes via email or in-app notification.
